Protective Award cases members of our Employment team have acted on: Pure Contract Furniture
Pure Contract Furniture Limited was incorporated in 2018 and was based in Stone, Staffordshire. The company operated as commercial furniture marker and supplied contract furniture largely to the hospitality and leisure industry.
Following a period of poor performance and increasing losses, the company entered into a Company Voluntary Arrangement (CVA) in December 2019 in an attempt to salvage part of the business. The company however was then faced with a winding up petition due to unpaid debts and so the CVA was terminated and the company was placed into Liquidation.
Most of the employees were made redundant on 14th February 2020 without being consulted with on their redundancies. The former employees approached SDM Legal shortly after their redundancies and a claim was lodged with the Employment Tribunal for a Protective Award.
Under s.188 of the Trade Union and Labour Relations (Consolidation) Act 1992 (TULRCA), an employer is obligated to collectively consult with its employees when proposing to make redundancies.
The case remains ongoing.
